Trademark Registrations: Should you register your mark or your logo first?
If you have a brand name and a mark but you also have a logo it can be difficult to decipher which to register first. Ideally the answer is, both! However, if you do not have the budget for both then here is what I recommend.
Start with your name.
First of all, you’ll get broader protection on that. And second of all, logos change quite often, especially when you’re just starting out. If you only have the budget to start with one, start with your name. Do your research to make sure no one else is using it. Businesses do not change their mark very often, but they’ll update their logo every now and then.
The other option is if you have a logo with your actual name on it, you can register that and get protection for both. The only caveat with that is you’d have to be using both at the same time. For example, if you sell clothing online you have to make sure that both the logo, the word, and the mark are together all the time. Meaning whatever trademark registration, you are filing has to be visible on both your website and your product.
